These terms apply to the purchase of the "MelanieChat" app and the Pro unlock through direct sales on melaniechat.eu between you as a consumer and VRX Enterprises LLC (30 N Gould St, Ste R, Sheridan, WY 82801, United States; contact: info@vrxenterprises.com). A consumer is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity.
The purchase contract is concluded with VRX Enterprises LLC. You order the Pro key by email or via the order form on melaniechat.eu. Once payment is received you get your personal licence key by email. The contract is fulfilled when you activate the key on your device.
MelanieChat is a client program for using AI services. The app establishes connections to AI providers you configure yourself. No warranty is given for the availability, content or cost of the external AI services (API fees of the respective providers); those contracts are concluded exclusively between you and the respective provider.
The price of the Pro unlock is €19.99 one-time (lifetime), including statutory VAT. Payment is made by bank transfer or by the payment methods offered on melaniechat.eu. Any ongoing costs of external AI providers are borne by you; the app displays cost and token usage transparently. Before expiry, a free 7-day trial with the full range of functions applies; afterwards the on-device mini AI remains available permanently and free of charge, as do home-network models with 10 requests per day in the free basic mode. This free basic mode is limited to plain text chat; extras (e.g. web search, video generation, read-aloud) as well as the generation and analysis of images and videos require a paid unlock (Pro).
With the purchase you receive a non-exclusive, unlimited in time, non-transferable right to install and use the app with your personal licence key on one Android device used personally by you. The key is bound to that device; when you change devices the key is reset free of charge on request. Passing on, sublicensing, renting out and reverse engineering are not permitted, unless mandatory law provides otherwise.
Consumers have a statutory right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise your right of withdrawal you must inform us (VRX Enterprises LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, United States, info@vrxenterprises.com) by a clear statement (e.g. email) of your decision. Sending the notice in time is sufficient to meet the deadline.
Consequences of withdrawal: in the case of an effective withdrawal, the services received by both parties must be returned. For digital content (licence key) the right of withdrawal expires early if you expressly agreed to the activation of the key and acknowledged that the right of withdrawal ends with activation (§ 356(5) German Civil Code, BGB). In the case of withdrawal the licence key is blocked and the purchase price refunded.
Statutory warranty applies. You can report defects to support@melaniechat.eu; where possible I provide an update.
I am liable without limitation for intent and gross negligence as well as for injury to life, body or health. For simple negligence, liability exists only for breach of essential contractual obligations and is limited in amount to the damage typical for this type of contract. There is no liability for the results of AI answers.
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. I am neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
German law applies, unless this removes mandatory consumer protection provisions of your country of residence. Should individual provisions be invalid, the remainder of the contract stays in force.
The app may let you download an AI language model (Qwen3, licence: Apache 2.0) once from the internet (Hugging Face) to your device (approx. 1.2 GB). The download is at your own responsibility; use Wi-Fi where possible, as data charges may apply depending on your mobile plan. After installation the model runs completely offline; no data is transmitted to third parties. The manufacturer gives no warranty for the suitability of the model on your device (at least 4 GB RAM recommended).
